This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
VivioMD Group LLC (“VivioMD”) provides non-clinical business support services and telehealth platform technology. Clinical services are delivered by affiliated professional entities, including OpenLoop Healthcare Partners PC and its affiliated medical groups, which are HIPAA Covered Entities. This Notice of Privacy Practices (“Notice”) applies to protected health information (“PHI”) handled through VivioMD’s platform in coordination with these medical groups. When it comes to your health information, you have certain rights. This section explains your rights and some of the Medical Groups’ responsibilities to help you.
You can ask to see or get a copy of your medical record and other health information the Medical Groups have about you. The Medical Groups will provide a copy or summary, usually within 30 days of your request, and may charge a reasonable, cost-based fee.
You can ask the Medical Groups to correct health information you think is incorrect or incomplete. They may say “no” to your request, but will tell you why in writing within 60 days.
You can ask the Medical Groups to contact you in a specific way (for example, home or office phone) or send mail to a different address. The Medical Groups will say “yes” to all reasonable requests.
You can ask us not to use or share certain health information for treatment, payment, or operations. The Medical Groups are not required to agree, and may say “no” if it would affect your care. If you pay for a service out-of-pocket in full, you can ask us not to share that information with your health insurer, and we will say “yes” unless a law requires us to share.
You can ask for a list (accounting) of the times the Medical Groups have shared your health information for six years prior to the date you ask, who they shared it with, and why. The Medical Groups will include all disclosures except those about treatment, payment, and operations, and certain other disclosures. The first list in a 12-month period is free; we may charge a reasonable fee for additional requests.
You can ask for a paper copy of this notice at any time, even if you agreed to receive the notice electronically. The Medical Groups will provide a paper copy promptly.
If you have given someone medical power of attorney or a legal guardian, that person can exercise your rights and make choices about your health information. The Medical Groups will confirm their authority before taking any action.
You can complain to us using the contact information at the end of this Notice. You can also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights: 200 Independence Avenue, S.W., Washington, D.C. 20201; 1-877-696-6775; www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.
For certain health information, you can tell us your choices about how we share information. You have the right and choice to tell us to: share information with your family, close friends, or others involved in your care; share information in a disaster relief situation; or include your information in a provider directory. If you are not able to tell us your preference (for example, if you are unconscious), we may go ahead and share your information if we believe it is in your best interest.
In these cases the Medical Groups never share your information unless you give written permission: marketing purposes; sale of your information; and most sharing of psychotherapy notes. Fundraising: we may contact you for fundraising efforts, but you can tell us not to contact you again.
The Medical Groups and their Providers (the Covered Entities) typically use or share your health information in the following ways. VivioMD, as a Business Associate, only handles this information on their behalf and under their direction.
The Medical Groups and Providers can use your health information and share it with other professionals who are treating you. Example: a doctor treating you for an injury asks another doctor about your overall health condition.
The Medical Groups can use and share your health information to run their practice, improve your care, and contact you when necessary. Example: health information is used to manage your treatment and services, such as sending appointment reminders.
The Medical Groups can use and share your health information to bill and get payment from health plans or other entities. Example: information about you is given to your health insurance plan so it will pay for your services.
The Medical Groups will not use or share your information other than as described here unless you authorize them in writing. If you authorize us, you may revoke it at any time.
